Description:

Form 706 is unlike most tax returns and requires a detailed understanding of how a decedent’s estate is valued, reported, and ultimately subject to federal estate tax. Proper preparation involves identifying and valuing the assets included in the Gross Estate, determining allowable deductions, calculating the taxable estate, and applying the available estate and generation-skipping transfer tax exemptions.

This fast-paced, practical course provides a step-by-step review of preparing Form 706 from beginning to end, with particular attention to the reporting of commonly encountered estate assets, permissible deductions, exemption allocation, and elections that can significantly affect the estate tax liability. Participants will also examine Portability and QTIP elections, including applicable filing requirements and timing considerations, and identify common errors and pitfalls that can result in unnecessary tax exposure or missed planning opportunities.

Learning Objectives

Upon successful completion of this course, participants will be able to:

  • Identify the assets that comprise the Gross Estate and determine how commonly encountered assets should be reported on Form 706 and its schedules.
  • Explain the major deductions available in calculating the taxable estate and determine how qualifying deductions should be reported.
  • Analyze the application and allocation of the estate tax and GST tax exemptions.
  • Explain the purpose and requirements of the Portability election and the treatment of the deceased spouse’s unused exclusion.
  • Evaluate the use of the QTIP election and its potential impact on the marital deduction and estate tax liability.
  • Identify appropriate elections based on the decedent’s estate planning documents and the circumstances of the surviving spouse and beneficiaries.
  • Determine the Form 706 filing requirements applicable to taxable and non-taxable estates.
  • Recognize common preparation errors and identify potential pitfalls when completing Form 706.
  • Apply a structured approach to preparing Form 706 from the initial gross estate calculation through the final tax and exemption calculations.
